Please read these Terms of Service ("Terms", "Terms and Conditions") carefully before using the www.kicksbymag.co.za website (the "Service") operated by kick's@mag. By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
1. CHANGES TO THE TERMS We reserve the right to update or modify these Terms at any time. Your continued use of the Service following the posting of changes constitutes your acceptance of the new Terms.
2. PRIVACY AND DATA PROTECTION Your privacy is important to us. We are committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA) and other applicable South African laws. By using our Service, you consent to the collection and use of your personal information as described in our Privacy Policy.
3. PRODUCTS AND PRICES
- Product Descriptions: We strive to describe our products accurately. However, we do not warrant that product descriptions are entirely error-free. If a product offered by us is not as described, your sole remedy is to return it in its original condition.
- Pricing: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
- Payment: Prices are displayed in South African Rands (ZAR). You agree to pay all charges incurred by you or on your behalf at the prices in effect when you place an order.
4. ORDERS AND PAYMENT
- Accuracy of Information: You acknowledge that you are solely responsible for the accuracy of your account and order details. We are not liable for any errors made by you during the checkout process.
- Payment Methods: We accept payments via our listed payment gateways (EFT, Credit Card, etc.). You confirm that the payment details provided by you are accurate and complete.
- Order Acceptance: All orders are subject to availability and our acceptance. We reserve the right to refuse or cancel any order for any reason.
5. RETURNS AND REFUNDS (CRITICAL) Please read this policy carefully as it differs from many other retailers.
- No Returns: Due to the exclusive nature of our inventory, WE DO NOT ACCEPT RETURNS. All sales are final.
- No Refunds: We do not issue cash refunds or credit card refunds for "change of mind," "size does not fit," or "style preference."
- Cancellations: You may cancel your order within 24 hours of placing it, provided that the order has not yet been processed and handed over to the courier.
- Defects: In the unlikely event that you receive a defective or damaged product, you must notify us via WhatsApp (071 739 5353) within **24 hours of delivery. You must provide photographic evidence. Upon verification, we will offer a replacement of the same model, subject to availability. We do not offer refunds for defective items; we only offer replacements.
- Hygiene Items: Socks, underwear, and certain accessories are non-returnable and non-refundable for hygiene reasons.
6. INTELLECTUAL PROPERTY All content included on the Service, such as text, graphics, logos, images, and software, is the property of kick's@mag and protected by copyright and other intellectual property laws. You may not use, reproduce, modify, or distribute our content without our express written permission.
7. USER ACCOUNTS If you create an account on our Service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to your account. You agree to accept responsibility for all activities that occur under your account or password.
8. LIMITATION OF LIABILITY To the fullest extent permitted by law, kick's@mag, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors:
- Shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. INDEMNIFICATION You agree to indemnify and hold harmless kick's@mag, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims arising out of or related to your breach of these Terms and Conditions or your use of the Service.
10. GOVERNING LAW These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. You hereby submit to the exclusive jurisdiction of the courts situated within South Africa.
